Compromise Agreements
If your employer wants to terminate your employment they will often ask you to sign a Compromise Agreement.
Basically under a Compromise Agreement in consideration of a payment you will agree not to pursue specified employment claims against the employer.
One example of where this happens in practice is if the employer wants to terminate your employment quickly without following correct procedures , for instance if they don’t want to adhere to disciplinary procedures or if they haven’t carried out a detailed consultation exercise in the case of redundancy.
However, a Compromise Agreement will not be enforceable unless you have taken independent advice from your own solicitor ( who has to sign a statement confirming that they have advised you ) . The employer will usually pay your solicitor’s costs in giving you this advice .
This is where we come in . We will establish if you are happy with the way you have been treated and the sum of money on offer. We will go through all the relevant facts with you and advise you on what your legal position would be if you did not sign. If you are likely to be out of work for a long time this may affect the advice. If we identify issues that you want to pursue we will negotiate with your employer to try to improve the financial package on offer or change some of the terms – for instance to make sure the employer gives you a reference in terms you are happy with. However, sometimes we will sign off the Compromise Agreement without amendment having given you the necessary advice.
With over 10 years experience in this area and we are able to offer practical commercial advice.
"I was given excellent commercial advice from Batchelor Myddelton in my recent redundancy settlement . This resulted in a considerable increase in the amount I received from my former employer. My case was dealt with in an efficient professional manner that resulted in an improved early settlement"
